Congress ignores the constitution

This past week I listened to a number of representatives debate over repeal of ObamaCare on the House floor.   A few Democrats have made the claim that their authority to force this terrible law on each of is derived from the constitution.  Representative Sheila Jackson Lee from Texas actually stated that  the act of repealing ObamaCare was unconstitutional.  Clearly she has lost her way and doesn’t understand the basics of our constitution.  The only thing the constitution has become to her is a prop to use in the political theater that has become Washington D.C.  She is not alone.  Many in D,C, have very little understanding of our constitution or simply don’t respect its limitations it places on the federal government.  Many do not under stand that the constitution was carefully crafted to protect the people from an imperfect federal government.  As it is most governments are imperfect in their nature and must be kept in check; the constitution is designed to do just that.  Why this is a difficult concept to grasps for our elected officials is beyond me.  It’s not rocket science.

Judge Andrew Napolitano eloquently makes the case that Congress ignores the constitution in the below clip.

I couldn’t have said it any better than the judge.  This is how far our congress has strayed off course.  And now they act surprised when States like Idaho are openly talking about nullification of ObamaCare.  How do we correct the course of our elected officials and demand that they respect the constitution and the limitations it places on them?  We continue to stay engaged and be the squeaky wheel.  We can make a difference, it”s just going to take a sustained effort on our part.

Liberty forever, freedom for all!

Well, when you look at it the way the Judge does, it’s pretty plain. It appears that Congress has been in this same mode of operation for a very long time. Because it is like this, it is not going to be an easy task to change the way they think and work. Is it possible in our lifetime, do you think?

    Good post, John.

I think the only way you change the way the mindset is to change them out every two years until they do get it. If it becomes a revolving door then so be it Larry.

The scariest thing to me in the video was the 4000 criminal laws our Federal government has enacted. Couple that with the state criminal code we are all subject to and with the adage from the state that “ignorance of the law is not an excuse”, and we can easily see that if the government truly wanted to, it could probably find a way to arrest anyone. I am not suggesting some weird conspiracy theory here, I am talking about a possible and frightening future.

I like the use of the squeaky wheel – I think it would make a good slogan like, “Are you a squeaky wheel?” or “My squeaky wheel needs some oil – drill baby drill!” I don’t know, just seems it could make a good t-shirt. =)

How can we be a people that cherishes liberty and allow so many federal criminal laws on our books. This is a classic case of Americans over time trading their liberty for some type of security. It has happened piece by piece over many years and now we have a monster that has grown out of control. I think if we want to make a difference we do need to be the squeaky wheel.

The judge has nailed it and so have you, John. I firmly believe we can take our country back. I don’t know how many Tea Parties there are across the country but what ever the number is, we need to double it. There is nothing politicians fear more than the voice of the people.

I agree Jim. I think the tea parties need to turn inward towards the states because in the end the states must be the ones that rein in the federal beast.

Sadly many in congress are like the over zealous 2nd Lieutenant. They are ignorant of the regulations and binding documents, don’t want ot hear about anything that limits their power, and are really only there for the salary and benefits. I am willing to bet there are a few who are not well educated and elected on charisma alone. When George Mason insisted on the “Bill of Rights” being in the constitution he never had universal health care in mind, although at the time “Health Care” included blood leting and leeches. He never wrote on his thoughts on it, neither did Madison (That I am aware of). So to say its constitutional is about on the warning track out in left field. ( see what I did there).Democrats and Progressives need to realize that

    1. Universal health care is NOT in the constitution
    2. It was an idea first tried by FDR
    3. Was soundly defeated in the 90’s ( Hillary care)
    4. Obamacare is not even close to the universal health care you think it is.

Even as a shallow left field Democrat I can see there is nothing good about Obamacare.

Thanks for the comments Andy. I say let’s try following the constitution again and see where it takes us. It served this nation well for the first 150 years, why not give it a try again.

Sheila Jackson Lee lost her way long ago, like at birth. A woman that believes the Mars pathfinder is on the moon, that North Vietnam is a peaceful nation and that China has a good track record on human rights has any credibility? Worse yet, her district keeps re-electing her!

But the Constitution is, like, so old!. It’s over 30 years old or something.

Seriously I’m surprised the left has even heard of the Constitution.

Worst of all, these so called “laws” were never enacted by Congress or any other legislative body, but rather by beaurocrats who filed a “rule” which may or may not have any basis upon which it is derived. As Dean, said, he didn’t care if what they did was constitutional or not, let the courts decide, and we know where that may leave us.

The courts have always been a key player in the left’s evil plan Bunker. If the people speak through the ballot and the left doesn’t agree…well let the courts decide and overrule the will of the people. That’s how they roll.

I figured that in 2010, Sheila Jackson Lee would finally get the boot. She has a proven track record of saying such obviously moronic things that I would think her district would tire of being embarrassed by her continued presence in the House. Unfortunately, SJL managed to dodge the big red midterm wave.

It’s almost like how sometimes when a person survives a heart attack they feel emboldened to eat bacon-fried triple cheeseburgers. Now that SJL has survived the 2010 midterms, she’s doubling down on the stupid.

At least it’ll be enjoyable to make fun of her wacky nonsense.

What a great video by Judge Napolitano, he sums it all up. It seems so easy to understand and yet the Congress does not understand and I guess that is our fault because we haven’t help them properly accountable. Until we get back the the principles of smaller, limited government we can expect the Congress to keep breaking their ulimate contract with us–the constitution.
    Great post, John!

Thanks Steve. The key is we need to be as loud as the left in regards to the constitution. They want to scream it is a living and breathing document that must change as any judge sees fit, we fire back with as much passion that it is what it is. That the way to change it is through the amendment process and not through the interpretations of unelected federal judges.

As FORMER Squeaker of the House Nancy Pelosi said when asked by a reporter if Obamacare was Constitutional, “Are you serious, Are you serious.” Yes, Nancy, we are serious. Check the results of Nov. 2010.
