Teeing it up: A Round at the LINKs (Pro Forma Edition)

I took the last couple of days off to collect my thoughts and recharge.  The big news of last week was President Obama’s decision to make four recess appointments while congress was still in session under a procedural rule called pro forma.  This pro forma rule was first implemented in 2007 via a senate controlled by the Democrats to prevent then President Bush from making any recess appointments.  Following the advice of his lawyers, President Bush decided that any appointments made during the pro forma session would indeed violate the constitution.  Article I, section 5 of the constitution clearly states that each House may determine the Rules of its Proceedings.

When the senate crafted this pro forma procedural rule in 2007 it was and is perfectly legal per the constitution; however the President’s actions in making these appointments are not legal. Congress was still in session when he made these unauthorized appointments. A few so-called constitutional experts have argued that the President has the constitutional authority to make these appointments because Article II, section 3 authorizes the Executive Branch the power to adjourn both Houses when there is a Case of Disagreement between them, with Respect to the Time of Adjournment.  This argument might be somewhat valid if there was an actual disagreement as to the time of adjournment; however there is not because they were not in a state of adjournment.  The House did not adjourn the session so the time of adjournment is not in question.  Think about it, if the President has the power to just adjourn the congress whenever he sees fit then what would be the point of needing the advice and consent of the senate when making departmental appointments.  Additionally by ignoring the will of the senate and house the President is actually ignoring the will of the states (senate) and the will of the people (house).  This is why we cannot remain silent in regards to the President’s actions.

Many of you might believe we’re splitting hairs here, but you need to understand that a republic is held together by its rules and procedures.  It is the glue that keeps the republic intact and when they are ignored or violated the republic begins to come undone.  When we the people allow one branch of government (Executive) to run roughshod over another (Legislative) without so much as a word, then we are allowing tyranny to gain a foothold.  It matters very little if you fall on the left or right, or are a Republican or Democrat, each of us has a responsibility to act on behalf of our children, our constitution, and our republic. Liberty is worth preserving!

    Your comments about government following rules and procedures are spot on. Our republic is not held together by magic–its continuance depends upon politicians and bureaucrats following the rules and laws. We are already headed down a bad road.

    Thanks for the link John. Barack Obama has stepped into uncharted waters with this pro forma move and it will be interesting to see if the Congress has the political courage to take him on in an election year, I have a feeling they won’t.

      This is why he waited for an election year. He knows the Republican leadership is weak. John Boehner showed how weak he was when he caved in right before the Christmas break. He is more concerned with not rocking the boat than he is with doing the right thing. This is why our weekly video is so appropriate. Maybe we’re all being scammed by these politicians.

    Nice synopsis John. I’m afraid this will go nowhere. Some will give credit to Obama for once again out-maneuvering the GOP. Some will say the GOP leadership is just flat-out weak. Either way, same result. The average guy on the street couldn’t care any less about this. Those who are interested will buy the Obama narrative that the Senate is merely playing political games by gaveling in and out in a thinly veiled attempt at staying in session.

    Obama is simply a better politician when it comes to capitalizing on the public sentiment. He chooses his battles wisely. Health care, corporate bashing, etc. I know that guys like yourself will do their level best to expose these things because it is no less than attack on our liberty. Keep up the good work.       Thanks. Anyone who supports the actions of the President is not a friend of the constitution or the republic. And if this is the case they stand against liberty and freedom. This is how the argument needs to be framed, because this is how it is.

    Obama’s recess appointment without actually waiting for a recess, is just the latest in questionable, extra-Constitutional and un-Constitutional acts by the supposed Constitutional scholar in the White House.

    The heat needs to be brought over this. If necessary, the loyal opposition needs to grow a spine.
