Teeing it up: A Round at the LINKs (Keystone Pipeline edition)
Well the top stories of the week were Newt Gingrich winning the South Carolina primary and President Obama once again exercising power not granted to him by the constitution in killing the Keystone Pipeline project. Newt’s strong debate performance catapulted him to a victory in South Carolina in the wake of a controversial ABC interview with his ex-wife Marianne Gingrich. It was an impressive victory.
Next we saw the President kill the Keystone Pipeline project claiming he needed more time to study the impacts. So where exactly in the constitution is the President granted the authority to regulate commerce with foreign nations and the states? The answer is has zero authority and his killing of the pipeline means nothing. The enumerated powers of congress are covered in article I, section 8. This is the section that grants congress not the President the power to regulate commerce with foreign nations and among the several States, and with the Indian Tribes. So basically the President’s actions in this matter are unconstitutional and should not carry any weight. The companies involved in the construction of the pipeline do not need the approval of the President, they simply need to remind congress that they have the authority in this area. This is a position supported by a study conducted by the nonpartisan Congressional Research Service. The study concluded that even though Presidents have made executive decisions on pipelines that cross the borders in the past, congress has the final say in regards to granting permits and they have the full weight of the constitution to back them up. Basically the President is living under the illusion that he matters in this fight.
The sad and pathetic thing about all this is we have an ignorant left who clearly has no understanding of our constitution and the enumerated powers of congress. They protest and demand the President exercise power he’s not constitutionally permitted to exercise. The same holds true with the President violating the constitution when he made his pro forma appointments a few weeks ago. Our republic is struggling not because there is too much liberty and too little regulation. Our republic is struggling because there is too little liberty and a too much regulation. And this only happens when our elected officials operate outside of the parameters of their constitutional authority. It’s not rocket science folks? We shouldn’t be looking for a candidate to solve our economic woes. We should be looking for one who will reestablish the constitution as the law of the land and restore individual liberty as well as economic liberty. Once this happens our republic will grow stronger and the individual along with it.

No problem 5etester. You’re probably right when you say it will eventually makes it way here. The one thing for sure is the President did not have the authority to stop this and my guess is congress will finally realize they have the power.
