Senator Patrick Leahy plants the seeds of judicial activism if ObamaCare is ruled unconstitutional

A few days ago the Chairman of the Senate Judiciary Committee, Senator Patrick Leahy (D VT) picked up on the Senate floor where the President left off two months ago in regards to trying to intimidate the SCOTUS.  The truth is this vote has already been cast and I believe at a minimum the individual mandate in ObamaCare is going to be ruled unconstitutional.  I also believe there is a very good chance the entire law could be thrown out.  Let’s face it the defense of the individual mandate did not go well for the Obama administration.  In fact I’m not even sure all the left leaning judges were buying the argument.

This same opinion that I have about the fate of ObamaCare must also be running through the halls of congress.  Perhaps even the results of the vote have leaked into the inner circles of the Obama administration and the senate.  This could be why they were so desperate to hire 4,000 additional IRS agents after the arguments went so badly for them in front of the SCOTUS and why the Republicans blocked it.  Even though I can’t prove it in my opinion someone leaked information that ObamaCare’s days were numbered to the Obama administration shortly after a decision was made.  This is why I believe he went on the offensive so soon after closing arguments.  At that point he was trying to intimidate the court because it was still fresh.  However what Senator Leahy is doing is planting the seeds of judicial activism.  Check out the following video clip.  See how Patrick Leahy carefully plants the seed of judicial activism only days before the ruling is expected to be announced.

The end goal here is delegitimizing the SCOTUS in the hopes of turning the people against the very branch of government that is responsible for ensuring the constitutional restraints placed on the government are upheld.  The left and some on the right want unlimited power to do as they wish and the constitution is an obstacle.  The SCOTUS is responsible for ensuring the actions of the government do not exceed their constitutional authority and trample on rights of the people even when the people are more than willing to sacrifice their liberties for some false sense of security.  You see in the end there are enough ignorant people (mob) out there to whip into a frenzy about judicial activism to upset the apple cart and the left knows this.  After all the left has spent a generation peddling the snake oil that the constitution is a living and breathing document that can change as easily as the wind changes direction.  How dare any judge go against the “will” of the people even if the “will” of the people was rammed through congress in the most unethical manner.  This is the lie that Senator Leahy needs you to buy into.  He wants you to disregard the manner in which ObamaCare was passed and focus on the institution that is charged with ensuring your unalienable rights are secured even when the mob doesn’t know any better.  Leahy needs the mob and the mob requires a seed to be planted within to feed their fury.  This is what this speech on the floor of the senate was all about…planting that seed.  Nothing more, nothing less.

    I guess what he is saying is that if the Congress passes a bill it is automatically constitutional and therefor cannot be overturned. He doesn’t seem to understand the role of SCOTUS or he hopes enough people don’t understand the court’s role.

      I believe it’s the latter. He understands the role of the SCOTUS, he just doesn’t care. He’s counting on the ignorance of the mob to turn against the SCOTUS. This is why he is planting the judicial activism seed.

    He is truly setting the stage for the Supreme Court to be attacked, if they don’t like the way the Court rules on Obamacare.

    Liberals end up destroying everything they touch. They are illegitimate, so they must delegitimize everything that stands in their way. They cannot build up so they must tear down. Liberalism is a destructive ideology.

      It is indeed. I was telling someone the other day how I can’t wrap my brain around how any freedom loving American can embrace liberalism. The person I said that to responded, not all Americans are freedom loving. How true is that.

    Since FDR, the left thinks there is no limit on the federal government’s power. I wonder what Leahy thinks the part of the constitution about the seperation of powers is about? People like him were not concerned when the judicial activism goes in their favor; such as, Roe vs Wade. Judicial activism is always bad! To aprove the Affordable Care Act, would require activism on the part of the Justices.

      Exactly Jim! It’s only judicial activism when it goes against what they’re trying to accomplish. And because everything they’re trying to accomplish is not permitted by the constitution…it’s all judicial activism.
